This End User License Agreement ("EULA") governs your use of software, firmware, mobile applications, web dashboards, and related documentation (collectively, the "Software") provided by Supertec Incubators ("Supertec," "we," or "us") in connection with Supertec hardware and services. By installing, accessing, or using the Software, you agree to these terms. If you do not agree, do not install or use the Software.
License grant
Subject to your compliance with this EULA, Supertec grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Software solely for your internal or personal operation of genuine Supertec products in accordance with documentation and applicable export and sanctions laws.
- Updates and upgrades may be provided automatically; continued use after an update constitutes acceptance of amended terms presented at install or first launch where required by law.
- Open-source components, if any, are licensed under their respective third-party licenses, which prevail for those components.
- You are responsible for maintaining the confidentiality of account credentials and for activity under your account.
Restrictions
You shall not, and shall not permit others to:
- Copy, modify, translate, or create derivative works of the Software except as allowed by mandatory law.
- Reverse engineer, decompile, or disassemble the Software except to the limited extent expressly permitted by statute.
- Remove, alter, or obscure proprietary notices, telemetry safeguards, or license controls.
- Rent, lease, sell, distribute, or host the Software as a service for third parties without written consent.
- Use the Software to build a competing product, benchmark publicly without permission, or scrape or harvest data in violation of applicable terms or law.
- Use the Software in any way that harms Supertec, other users, or third parties, or that violates applicable law.
Intellectual property
Supertec and its licensors retain all right, title, and interest in the Software, including copyrights, patents, trademarks, trade secrets, and know-how. No rights are granted except the limited license above. The Supertec name, logos, and product identities are trademarks of Supertec or its affiliates; unauthorized use is prohibited.
DMCA — copyright infringement notices
If you believe that material accessible through Supertec-operated websites, apps, or services infringes your copyright, you may submit a notice. For notices intended to comply with the U.S. Digital Millennium Copyright Act (DMCA), or analogous notices under other jurisdictions, your communication should include:
- Identification of the copyrighted work you claim has been infringed.
- Identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate it (e.g. URL, account identifier, or description of where the material appears).
- Your name, address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and under penalty of perjury (where applicable), that you are authorized to act on behalf of the copyright owner.
- Your physical or electronic signature.

Where applicable law provides for counter-notices or reinstatement procedures, we will follow those requirements. Repeat infringers may have accounts or access terminated. Supertec may forward notices to users or hosting providers as required by law.
Disclaimer
The Software is provided "as is" to the extent permitted by law. Supertec disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement except where such disclaimers are prohibited.
Limitation of liability
To the fullest extent permitted by law, Supertec shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business interruption arising from use of the Software. Supertec's aggregate liability for any claim relating to the Software shall not exceed the greater of the amount you paid for the Software or related services in the twelve (12) months preceding the claim or one hundred U.S. dollars (USD $100), except where liability cannot be limited by applicable law.
Governing law
This EULA is governed by the laws of Sri Lanka, without regard to conflict-of-law principles that would require application of another jurisdiction's laws. Subject to mandatory consumer protections where you reside, courts in Sri Lanka shall have jurisdiction over disputes arising from this EULA, except where treaties or binding regulations provide otherwise.
Termination
This license terminates automatically upon material breach. Supertec may suspend or terminate access to cloud features for inactive, fraudulent, or abusive accounts. Upon termination, you must cease use of the Software and destroy copies in your possession except archival copies required by law.
Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and governing law) remain in effect after termination.
Enterprise customers, beta participants, or regulated deployments may be subject to separate written agreements that supplement or replace portions of this EULA.
